What is a “duty of care”?
The Australian legal system dictates that a professional person undertakes to provide a reasonable degree of care and skill in performing their services. This is the duty of care that a professional person owes to their client. If a professional person is found to have breached this duty of care then they may be sued for professional negligence and be ordered to pay damages.
