What is non-economic loss and am I entitled to compensation for non-economic loss?
You are not automatically entitled to receive compensation for non-economic loss even if you have shown that you are the victim of medical negligence.
Non-economic loss will only be awarded by the court if the severity of your injuries is at least 15% of "a most extreme case". If the severity of your injuries is greater than 15% of a most extreme case then you will be awarded compensation for non-economic loss in accordance with the legislation with the current maximum amount recoverable set at $427,000.00.
